Treaties do not apply themselves. A bank, a pension fund or a foreign tax office will want a certificate, with the right wording, for the right year. We request it and follow it up.
The same phrase covers two different documents, and confusing them is the commonest reason for delay:
We obtain the first. For the second we tell you exactly what to ask your own tax office for, and we check it when it arrives.
The Spanish tax agency issues a general certificate of residence and a certificate "for the purposes of the treaty" with a named country. Foreign payers almost always need the second: it states that you are resident in Spain within the meaning of the specific treaty. Sending the general one is the usual reason a foreign pension fund rejects the paperwork.
The agency issues it on the basis of what it already knows about you. It is straightforward when you have filed Spanish resident income tax returns. It is difficult in the year of arrival, before any return has been filed, and applications in that year are often refused or left unanswered. In that case the request has to be supported with evidence: registration at the town hall, a lease or purchase deed, social security registration, school enrolment.
Certificates refer to a tax year and foreign payers generally want a fresh one each year.
The fee is €104 per certificate, taxes included. It is included in our yearly pension services, where the certificate is part of the job.
Each of these may have its own form, to be stamped by the Spanish tax agency, in addition to or instead of the Spanish certificate. Asking the payer exactly what it needs, before applying, saves a round trip.
The difficult case is the person who has just moved. The foreign payer wants proof of Spanish residence now. The Spanish tax agency has no return on file, and residence for a calendar year is only certain once more than 183 days have passed.
What can be done:
Whether you are in fact resident in that first year, and from when, is a question in its own right: see tax residency in Spain.
